"User files" is just the Home folders (/Users). The data volume is copied (and updated) using "Backup - all files" with "Smart Update" under Big Sur and later.

SuperDuper doesn't move them...

This is only an issue when Apple's replicator is used. I would suggest not scheduling it to erase, and do that manually - use Smart Update on a schedule.

We can hope Apple will fix this at some...

Yup. Since the behavior had already been defined with regard to Smart Update (which can update the OS under Catalina) it always copies the OS. The data volume on its own (if given the Data role)...
